Navient’s $ 2.5 million TCPA settlement completed

A proposed class comparison on February 8th Received final approval on a case of alleged violations of the Telephone Consumer Protection Act (TCPA) against Navient Solutions, LLC. The settlement grants the class $ 2.5 million. Upon approval of the court settlement, the award will award $ 833,333 in legal fees and $ 24,379.83 in costs and expenses.

the Class action lawsuit against Navient was filed in October 2017 alleging that Navient used an automatic telephone dialing system (ATDS) to place unsolicited calls requesting location information on third party cell phones. According to the complaint, the assistant plaintiff’s brother had a student credit account that was on deposit with Navient for collection. The applicant was listed as a reference in her brother’s student loan application without her knowledge or consent. The plaintiff had neither entered into an agreement with Navient nor given her consent to call her mobile phone. The complaint also alleges that these third parties continued to be called even if they did not request any further calls.

the comparison states that Navient “vigorously denies all claims made in the lawsuit and denies all allegations of misconduct and liability, and specifically denies that the disputed calls were made using an ATDS”.
