Court increases aid amount for injured bus passenger | Madurai News
Madurai: Madras High Court increased compensation for a man who suffered injuries while getting off a government bus in Madurai district in 2007 from Rs 62,500 to Rs 1.40 lakh.
The Grievor L Vinoth was traveling on the bus on October 6, 2007 when the incident occurred. He was getting off when the driver negligently moved the bus, causing him to shift the rear wheel over his left thigh. The petitioner suffered injuries and was admitted to the government hospital in Rajaji, then transferred to a private hospital where he underwent surgery.
The Madurai Traffic Accident Compensation Tribunal (MACT), from which he sought compensation, ordered the district transport company to pay him 62,500 rupees in 2010. Challenging the order, he filed the present various civil action before the bench of HC Madurai in 2014. The appellant argued through his lawyer that he was 19 years old at the time of the accident. He underwent two surgeries and submitted medical bills worth Rs 82,828, but the same was not considered by the court.
Counsel for the transportation company argued that the appellant was moving on the running board of the bus and invited the accident.
Therefore, contributory negligence should be attributed to the appellant. Judge R Tharani observed that the compensation set by the court for the percentage of disability was lower.
Therefore, the judge increased the compensation from Rs 62,500 to Rs 1.40 lakh and ordered the transport company to pay the amount in eight weeks.
